Brandy Crash -- Dead Woman at Fault?

TMZ has learned the hang-up in deciding whether to file vehicular manslaughter charges against Brandy is that Brandy may have been a victim, not a culprit.

A CHP source tells TMZ the woman who died in the car accident involving Brandy actually struck the vehicle in front of her before Brandy made any contact. The law enforcement source says Awatef Aboudihaj, the woman who died, struck the car in front of her -- which was going 65 mph, and then slammed on her brakes. We're told the sudden stop caused Brandy to hit the dead woman's car.

What's more, L.A. County Coroner spokesperson Captain Ed Winter tells TMZ that toxicology reports show Aboudihaj had "slight traces" of marijuana in her system at the time of the crash.

The L.A. City Attorney has until the end of the business day on Friday to decide whether to file criminal charges against Brandy -- that's when the one-year statute of limitations runs out. Sources tell TMZ there is significant division in the City Attorney's office, and a decision still has not been made. The problem for the City Attorney: if they file manslaughter charges, they have to prove Brandy did something negligent -- and we're told that could be difficult if not impossible.

Trust me I guarantee there have been PLENTY of "Whites" that have gotten off on murder charges in your area over the years! They just weren't big enough or important enough to make worldwide news. 94. This is a clever lawyer trick to portray Brandy as a "victim". A "victim" will always get sympathy in court. Most people with common sense can see through this but they have to try to get the possible manslaughter hanging over her head removed from the case. If the judge is worth anything he will proceed under the traffic laws that you must always be able to stop your moving vehicle to avoid rear end accidents in all conditions. If they suceed in getting her off on this "excuse" then people will be "victims" of slick roads caused by rain, snow and ice. She should at least bear the responsibility of some form of negligence in the collision and that severity, regardless of who hit who first, should be weighed by only the facts of whether her collision was the cause of injury and/or death or just property damage.

96. 26. Let's say there is an accident on the 405..first car stops suddenly and causes a chain reaction that involves 5 cars..you can't tell me that the 5th car is just as responsible as the first car. While it would have been great if she would have been able to stop..the lady who died was more at fault as she hit the car in front of her first..and what about the lady who started the whole thing in t he first place, who slammed on her breaks? She caused the accident..what is her liability? If the accident is "always' the fault of the person who hits from behind, then the lady who died would be at fault, since she hit the lady in front of her FIRST!

97. Think about it - if you have already rear-ended somebody, can you be considered to be in control of your car? Being in control of you car means not being at a complete stop on a freeway where you are supposed to be traveling around 65 mph. If you are at a complete stop in the middle of a freeway they could assess some culpability on the fact that your car wasn't moving.

98. I think that some of us forget that many of TMZ's readers are teenagers. There is no reason to argue with that as they can rationalize pretty much anything. The deceased caused the accident. That doesn't make her a bad person. Clearly she got preoccupied doing something and hit the person in front of her at a high rate of speed and slammed on her breaks instinctively causing a chain reaction. This is an accident and Brandy was not at fault so there should be no criminal charges and certainly no civil damages either.

100. It must be nice to live in your easy black and white world Petunia. ... "Rearend accident is ALWAYS fault of the person behind." Have you ever heard of people who purposely slam the brakes on to cause an accident so they can sue? If the speed limit is 65 and you are on the highway and someone suddenly slams brakes on and comes to dead stop - I promise you, even with a very good travel distance between you and the car in front of you - you will have a nearly impossible task of avoiding an accident. Even if you say Brandy is negligent for not being able to stop (as victim was negligent also), she is being sued and will be held accountable in a civil case - if appropriate. However, I hardly think this means criminal charges are appropriate.


And by the way - if the trace amounts of marijuana had been found in Brandy's system - she would most definitely have already been charged and convicted!

101. #84 your comment equaliing Brandy to Nick Hogan is STUPID! Nick Hogan has a history of speeding and racing..He decided to race which resulted in the injuries ro his friend. Brandy stopped her car, because the lady in front of her hit another car..end of story!

102. ok i need to break this down for the idiot who said something about nick hogan. the hogan idiot was driving illegally, underage, and traces of alcohol in his system that his dad bought for him. he had a previous record for not being safe or smart on the roads and bragged about it to media outlets. his whole family has been caught and on tape illegally street racing and then lying without even blinking about it to more media outlets. nick hogan is guilty and the steps that family has taken to hide their assets in the process are uncanny. BRANDY IS NOT NICK HOGAN!

comparing her to oj is ridiculous. dont look at the fact that he got off for murder. you guys need to think about this a little more. with all his surgeries there is no way he physically did it. she was 6 foot and in shape and the other guy was 6 foot and heavily into martial arts. HOWEVER he had the money and wanted her gone, if the lawyers had done their job properly he would be in jail right now for planning the thing out and funding the operation with the columbian drug lords she owed money to. its not even close to being the same! i would have loved to see him get hammered but it isnt his fault they charged him with the wrong thing. 10 years ago and people are still bitter, think please!

and the race issue, are you kidding. rebecca gayheart hit, killed, and left the scene of the crime of a nine year old boy because she was too impatient to stop at a stop sign and came from behind another vehicle, cut them off, and ran it. gee i think i just saw her on the red carpet and i think she is now walking around with her baby telling the papparazzi no pictures please. nobody has anything negative to say about her and she was clearly at fault and didnt see 1 second of jailtime. now please continue to make this a race issue.

and the family of the victim. it was always stated that there were 3 cars involved in the accident and yet the only person they are suing is the one with deep pockets. i understand they are hurting but you cant put a pricetag on somebody's life.

Rbecca Gayheart' little traffic thing happened just like this and that White girl is enjoying her life tothefullest being richand famous.

Race has nothing to do with this.
I do not care for Black Brandy one way or another.
Brandy is going toahve to pay a hefty settlement to Anwar(the dead woman's family). That is definite. Her attorneys might as well start the offereing ASAP!! Being somewhat famous,the car that was struck by Anwar (the deceased woman) will also want and will get a nice sum from Brandy even though they should and hopefully will goafter Anwar's insurance company too. Brandy ,being somewhat rich and famous, will have to brankrupt herself personally topay off the money both parties will seek and will win. Brandy really does not have that muchmoney.
Going inBrandy's favor is Anwar having weed in her system. Going in Brandy's favor is that Anwar struck the car 1 in front of her first. 1-unknown car hit by Anwar 2 Anwar ' car 3 brandy hit Anwar 1-2-3 car collison. Unfortunately a fatal was the result.
